1. Safety Regulations

  • Gas Safety (Installation and Use) Regulations 1998 & Amendment 2018
    As a landlord, you must ensure that all gas appliances and installation pipework in your property are maintained to a safe standard. This involves:
    – Ensuring appliances are checked annually by an approved Gas SAFE registered contractor.
  • Providing tenants with a copy of the gas safety certificate within 28 days of inspection.
  • Keeping the gas safety certificate for a minimum of two years. Failure to comply can lead to severe consequences, including a criminal record, fines, or imprisonment. Always verify that your gas safety certificate lists all appliances and confirms their safety.
  • Furniture and Furnishing (Fire) (Safety) Regulations 1988 (Amended 1993)
    This regulation applies to all soft furnishings, including: – Mattresses, sofas, chairs, and cushions. All furniture must have a permanent label attached, and materials must meet specific ignition resistance requirements.
  • Smoke and Carbon Monoxide Alarm Regulations 2015
    Landlords must ensure:
  • A smoke alarm is installed on every storey with living accommodation.
  • A carbon monoxide alarm is installed in any room with a solid fuel burning appliance. Regular checks should be conducted to confirm that alarms are in working order at the start of the tenancy.
  • Electrical Equipment (Safety) Regulations 1994
    Ensure all electrical equipment in your property is safe. This requires:
  • A qualified electrical engineer to inspect and provide an Electrical Installation Condition Report (EICR) every five years.
  • Providing a copy of the EICR to tenants at the start of the tenancy. These regulations focus on fixed wiring and do not extend to portable appliances.

 – Energy Performance Certificates (EPC)

-All rental properties are legally required to have an Energy Performance Certificate prior to marketing a property. This document shows how energy efficient your property is and allows tenants to make an informed decision with regards to their expected energy costs.

2. Leasehold Properties and Mortgages

If your property is leasehold, it’s your responsibility to:

– Ensure any letting complies with your lease terms.

– Obtain written permission from your superior landlord if required.
If your property has a mortgage, obtain written permission from your lender to rent it out.
Remember, applying after securing a tenant could complicate the process.

3. Landlord Contact Information
You must provide your tenants with your contact address, which should be an address in
England or Wales. Failure to do so can result in penalties, including withholding of rent.

4. Insurance
Ensure your property and its contents are adequately insured, including third-party liability risks. Inform your insurer that the property is being rented; otherwise, your policy could be void.

5. Tax Obligations
All landlords, whether in the UK or overseas, must:

– Declare their rental income from UK properties.

– Notify HM Revenue & Customs (HMRC) at the start of each tenancy.
Overseas landlords may be subject to tax deductions and must stay updated on regulations.

6. Tenancy Deposit Protection
